More than that, Nigerians express overwhelming optimism about the technology’s potential: 87% believe AI’s benefits outweigh its risks, and 90% expect positive impacts, particularly in medicine and science.

Already, AI-driven innovations are addressing Nigeria’s long-standing challenges across core sectors. In healthcare, AI tools are assisting in diagnostics and medical logistics. Yet for all this promise, Nigeria still grapples with substantial structural hurdles. A significant shortage of AI talent persists. Despite having a draft National AI Strategy and several sectoral laws in place, Nigeria lacks a comprehensive regulatory framework for artificial intelligence. To bridge this gap and harness the technology’s full potential, Nigeria must craft its own national AI Act—a framework that reflects local realities while aligning with international best practices.

The foundation of this Act should rest on five key pillars:

  2. Ethics & Safety

  3. Adoption

  4. Education

  5. Governance

Each of these pillars is essential to creating an AI ecosystem that is both innovative and ethically grounded.

What Should Nigeria’s AI Act Look Like?

A practical Nigerian AI law can begin by adopting the EU’s risk-tiered approach. Ban AI use cases deemed unacceptable, such as social scoring or biometric surveillance in public spaces. For high-risk tools, impose strict auditing, logging, and registration requirements. Meanwhile, allow low-risk systems, like chatbots and productivity assistants, to operate with minimal interference.

From the UK model, Nigeria can borrow the idea of empowering sector-specific regulators—for instance, having the Central Bank of Nigeria (CBN) regulate AI in finance or the Nigerian Communications Commission (NCC) oversee telecom-related AI applications. These watchdogs can respond quickly as AI use cases evolve within their domains.

To preserve human agency, the law should guarantee that any significant algorithmic decision—like a loan denial or medical diagnosis—can be overridden by a human within 48 hours. Enforce this through legal backing and financial penalties to ensure compliance.

Transparency must be a central tenet. AI systems should carry explicit labels, synthetic media should be watermarked, and all critical AI decisions should be logged for at least five years. Public registries should offer plain-English summaries of how systems work, enabling informed public scrutiny.

Fueling Growth Alongside Regulation

Regulation must go hand in hand with economic incentives. Nigeria’s AI law should support regulatory sandboxes under the National Information Technology Development Agency (NITDA), where startups can test solutions in real-world conditions with reduced legal exposure.

Offer micro-grants, tax holidays, and shared computing resources to help early-stage companies move from prototype to market. Public funding should prioritize university-led research, converting Nigerian academia into a launchpad for local AI products that address African problems.
