The Family Court Division of the Delta State High Court in Ughelli has commenced hearings in a case involving allegations of trafficking and sexual exploitation of a 15-year-old schoolgirl by her mother. The case, initiated by child rights activist and Take It Back Movement Nigeria member, Ighorhiohwunu Aghogho, aims to secure justice and protection for the victim.
Presiding over the session, Justice Mary Gesikeme-Akebotah issued several interim orders while adjourning the case to December 13, 2024. Among the rulings was the appointment of Margaret Oghuvwu, proprietress of Triumphal Model School in Effurun, as the temporary guardian for the victim.
The court also directed the bailiff to serve the originating process and other notices to the Delta State Coordinator of the National Human Rights Commission and the Area Commander of the Nigeria Police via substituted service. Justice Gesikeme-Akebotah further restrained all parties from taking any further actions in the case until the substantive suit is resolved.
The plaintiff, Aghogho, representing himself, invoked provisions of the Delta State Child Rights Law 2008, the Child Rights Act 2003, and the 1999 Constitution to advocate for the child. He cited specific sections that empower him to act in the interest of the victim, including fundamental human rights guaranteed under Chapter IV of the Constitution.
Meanwhile, the Nigeria Police are expected to present the accused mother in court at the next hearing. The Legal Aid Council has also expressed interest in the case and has nominated a lawyer, Ayo-Okhiria Scott, to represent the applicant as the proceedings continue.
The court’s actions underscore its commitment to addressing child rights violations and securing justice for vulnerable individuals.
